User accounts

Account information must remain accurate, complete, and current. You are responsible for safeguarding your password and all activity under it, and must report unauthorized use immediately. You may not use an unlawfully available, infringing, offensive, vulgar, or obscene username or impersonate another person or entity.

Content and restrictions

You are responsible for the legality, reliability, and appropriateness of Content you post. You grant the Company a license to use, modify, perform, display, reproduce, and distribute it through the Service while retaining your rights. You warrant that you own or may use it and that it violates no third-party rights. Unlawful, defamatory, discriminatory, threatening, obscene, spam, malicious, infringing, impersonating, privacy-violating, or false Content is prohibited. We may refuse, remove, edit, limit, or revoke access to Content at our discretion. You use user-submitted content at your own risk.

Content backups

Although backups may be performed, the Company does not guarantee against loss or corruption and has no liability for data integrity or restoration. You agree to keep an independent complete and accurate copy of your Content.

Copyright and DMCA

We respect intellectual property rights. Copyright owners or authorized representatives may send a detailed infringement notice to [email protected]. A DMCA notice should include a signature, identification of the copyrighted work and disputed material, location or URL, contact details, a good-faith statement, and a statement under penalty of perjury that the notice is accurate and authorized. Misrepresentation may create liability. We may remove challenged material at our discretion.

Intellectual property and feedback

The Service, its original content, features, and functionality remain the exclusive property of the Company and its licensors and are protected by applicable law. Company trademarks and trade dress require prior written consent. You assign the Company all rights in Feedback or, if assignment is ineffective, grant a perpetual, irrevocable, royalty-free worldwide license to use and exploit it without restriction.

Third-party links

The Company does not own or control third-party websites and is not responsible for their content, policies, practices, or related loss. Review the terms and privacy policies of third-party services you visit.

Termination

We may immediately terminate or suspend an Account without prior notice or liability, including for breach of these Terms. On termination, the right to use the Service ends. You may terminate by discontinuing use.

Limitation of liability

To the extent allowed by law, Company and supplier liability is limited to the amount paid through the Service or $100 if nothing was purchased. Neither is liable for special, incidental, indirect, or consequential damages, including lost profits, data, business interruption, personal injury, or loss of privacy. Where local law prohibits exclusions, liability is limited to the greatest lawful extent.

“As is” disclaimer

The Service is provided “AS IS” and “AS AVAILABLE,” with all faults and without warranties. To the maximum extent allowed, we disclaim express, implied, and statutory warranties, including merchantability, fitness, title, and non-infringement. We do not warrant that the Service will meet requirements, achieve results, remain compatible, uninterrupted, reliable, accurate, current, error-free, or free from harmful components. Mandatory consumer rights remain unaffected.

Governing law and disputes

United States law, excluding conflict-of-law rules, governs these Terms, subject to other applicable laws. Before bringing a dispute, you agree to try to resolve it informally by contacting the Company. EU consumers retain mandatory protections of their home country.

United States legal compliance

You represent that you are not in a country subject to a United States embargo or designated as supporting terrorism, and are not on a United States prohibited or restricted party list.

Severability and waiver

If a provision is invalid or unenforceable, it will be interpreted to best accomplish its purpose and the remainder stays effective. Failure to enforce a right or obligation is not a waiver of it or of a later breach.

Changes to these Terms

We may modify or replace these Terms at our discretion. For material revisions we will make reasonable efforts to provide at least 30 days’ notice. Continued use after revisions means acceptance. If you disagree, stop using the Website and Service.
